1. Acceptance of Terms

By accessing and using ArtGraduates.com (the "Service"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ArtGraduates provides a free online directory platform where artists can create profiles to showcase their work and connect with viewers. The Service allows artists to:

• Create a public artist profile
• Upload images of their artwork
• Share biographical information and contact details
• Be discovered by viewers browsing the directory

All artist profiles are available in 17 languages (English, Czech, German, French, Spanish, Italian, Portuguese, Dutch, Polish, Ukrainian, Swedish, Turkish, Japanese, Chinese, Korean, Arabic, and Indonesian). Profiles include structured metadata optimized for search engines and AI systems, and a dofollow backlink to the artist's own website. We also publish a Magazine with in-depth interviews and an accompanying podcast.

3. Free Service & No Commission

ArtGraduates is provided free of charge. We do not require any commission or fees from sales facilitated through our platform - all transactions between artists and buyers are entirely between those parties. We reserve the right to introduce paid features in the future, but the core directory service will remain free. Users will be notified of any changes to pricing structure.

Transaction Disclaimer: ArtGraduates is a directory platform only. We do not facilitate, mediate, or assist with any sales or transactions. Even if an artist displays prices or contact information for sales purposes on their profile, ArtGraduates bears no responsibility whatsoever for any transactions, disputes, damages, losses, or any other issues arising between artists and buyers. All transactions are conducted entirely at your own risk and are solely between the parties involved.

Advertising: ArtGraduates does not display advertising. This is a deliberate choice to maintain a space free from commercial noise for artists and visitors alike.

4. No Warranties or Guarantees

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. Specifically:

• We do not guarantee continuous, uninterrupted, or secure access to the Service
• We do not guarantee that the Service will be error-free or bug-free
• We do not guarantee any specific outcomes from using the Service
• We do not guarantee protection against data loss

5. User Accounts

To create a profile, you must:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Accept sole responsibility for all activity under your account

6. Artist Qualifications & Curatorial Selection

Art School Graduation Preference:

ArtGraduates primarily features artists who have graduated from an accredited art school or university with a degree in fine arts or a related artistic discipline. However, a completed university degree is not a strict requirement, especially if you have been personally invited or recommended. Each application is reviewed individually. Profiles that do not meet our quality standards may be removed without notice.

Curatorial Selection:

All submitted profiles require email verification and are subject to curatorial review before publication. We reserve the right to accept or reject any submission at our sole discretion, without obligation to provide reasons. We will make reasonable efforts to review submissions promptly, but provide no guarantees regarding review timing.

No Guarantees Beyond Profile Display:

If you are selected for any offline event or printed publication, this will be governed by a separate agreement where you can confirm your interest and participation. Similarly, ArtGraduates has no obligation to provide any benefits not explicitly agreed upon in such a separate contract. Your profile submission creates no binding commitments beyond display on this website.

7. Content Guidelines

When uploading content to ArtGraduates, you agree that:

• You own or have the rights to use all uploaded content
• Your content does not infringe on any third-party rights
• Your content does not contain illegal, harmful, or offensive material
• Your content is appropriate for public viewing

We reserve the right to remove content that violates these guidelines without notice.

8. Intellectual Property

Your Content: You retain all rights to the artwork and content you upload. By uploading content, you grant ArtGraduates a non-exclusive, worldwide license to display, translate, and distribute your content across all language versions of the platform for the purpose of operating the Service.

Our Content: The ArtGraduates name, logo, design, and functionality are protected by intellectual property rights and may not be used without permission.

9. Social Media Sharing

By submitting your profile to ArtGraduates, you expressly agree and consent that:

• We may share your submitted images, profile information, and artwork on our social media profiles, including but not limited to Facebook, Instagram, and LinkedIn
• We may use your submitted content for promotional purposes across our social media channels
• We are not obligated to share any specific content and retain full discretion over what content is shared
• You will be credited appropriately when your content is shared, typically with a link back to your profile or personal website
• We may edit, crop, or modify images for formatting purposes on social media platforms

Important: If you do not wish your content to be shared on social media, please do not submit your profile to ArtGraduates or contact us to request removal of your content from our social channels.

10. Multilingual Translations

Artist profiles and image captions are translated into 16 additional languages using AI-assisted machine translation. By submitting your profile, you consent to this translation. All translated versions are stored in our database and included in search engine indexes. You may edit each language version independently after logging in. ArtGraduates makes reasonable efforts to ensure translation quality but does not guarantee perfect accuracy in all languages.

11. AI Systems and Discoverability

ArtGraduates profiles are structured to be discoverable by AI systems including but not limited to OpenAI, Google, Microsoft, Apple, and others. By creating a profile, you acknowledge that your public profile information may be crawled, indexed, and referenced by these systems when responding to user queries about contemporary art. This is integral to the platform's purpose of maximizing artist visibility.

12. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Impersonate another person or entity
• Attempt to gain unauthorized access to the Service
• Scrape, data mine, or collect user information without permission
• Upload malicious code or viruses

13. Limitation of Liability

To the fullest extent permitted by law:

• ArtGraduates shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• ArtGraduates shall not be liable for any loss of profits, data, or goodwill
• Our total liability shall not exceed the amount you paid for the Service (which is zero for free accounts)

14. Availability and Maintenance

We make no guarantees regarding Service availability. The Service may be temporarily unavailable due to maintenance, technical issues, or other reasons. We reserve the right to modify or discontinue the Service at any time without liability.

15. Account Termination & Suspension

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Use
• Upload inappropriate or offensive content
• Engage in abusive, fraudulent, or harmful behavior
• Misrepresent identity or credentials
• Remain inactive for extended periods

Suspended accounts: If your account is suspended, your profile will be hidden from public view but your data will be preserved. You may contact us to appeal the suspension or request account deletion.

Terminated accounts: Terminated accounts and all associated data (including uploaded images) will be permanently deleted.

You may delete your account at any time through your dashboard settings.

16. Third-Party Links

The Service may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of any third-party sites. Use of such links is at your own risk.

17. Data Backup

While we implement reasonable backup procedures, we do not guarantee protection against data loss. Users are responsible for maintaining their own backups of any critical content.

18. Indemnification

You agree to indemnify and hold harmless ArtGraduates and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your uploaded content
• Your violation of these terms
• Your violation of any third-party rights

19. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. Material changes will be announced on the Service. Continued use of the Service after changes constitutes acceptance of the modified terms.

20. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Czech Republic and applicable European Union regulations, without regard to conflict of law principles. Any disputes shall be subject to the jurisdiction of competent courts in the Czech Republic.

21. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Users have the option to voluntarily support ArtGraduates through donations. Such contributions are entirely optional and do not grant any additional rights, privileges, or advantages to the donor.
